Platform Policy: Tutoring

1. Introduction

This Platform Policy: Tutoring (hereinafter referred to as the “Policy”) governs the use of services, features, and functionalities specifically offered under the Tutoring platform (accessible via simplifytoday.ca/tutoring/) (hereinafter referred to as the “Platform” or “Tutoring Platform”) on the SimplifyToday website (the “Site”). This Policy applies to all Users and Providers (as defined in our Terms of Service) engaging with the Tutoring Platform.

By using the Tutoring Platform, Users acknowledge that they have read, understood, and agree to comply with this Policy in addition to the Site’s Terms of Service (the “TOS” or “Terms of Service”) and any other relevant policies of the Site, which are incorporated by reference.

This Policy is an extension of and should be read in conjunction with the Site’s Cancellation, No-Show, and Refund Policy (the “Base Cancellation Policy”). The definitions, terms, and conditions outlined in the aforementioned Base Cancellation Policy apply here, including those related to session cancellations, refunds, and penalties. This Policy further elaborates on the specific circumstances, procedures, and terms for cancellations, refunds, and No Shows, wherein all terms of the Base Cancellation Policy remain in effect unless otherwise specified in this Policy. Users should refer to the Base Cancellation Policy for additional details on cancellations and related procedures.

2. Scope

This Policy specifically governs the interactions and activities of all Users engaging with the Tutoring Platform on SimplifyToday. Within the scope of this Policy:

  • Students: Users who utilize the Platform to seek tutoring services are referred to as “Students”. Students are responsible for selecting, booking, and paying for tutoring sessions, as well as providing accurate information during registration and session booking. Students agree to adhere to rules regarding cancellations, no-shows, and appropriate behavior during tutoring sessions.
  • Tutors: “Providers” who offer tutoring services through the Platform are referred to as “Tutors”. Tutors are responsible for creating and maintaining accurate profiles, ensuring their services align with their descriptions, and providing services with professionalism and quality. Tutors must also comply with the Platform’s standards for communication, conduct, and all relevant rules and expectations outlined in this Policy.

The scope of this Policy covers all interactions between Students and Tutors on the Platform, including but not limited to registration, session booking, payment processing, session cancellations, no-shows, conduct during sessions, and dispute resolution. This Policy is designed to ensure that both Students and Tutors have a clear understanding of their rights, responsibilities, and expected behavior while using the Tutoring Platform.

By using the Tutoring Platform, both Students and Tutors agree to abide by the terms set forth in this Policy, in addition to the Terms of Service and any other relevant policies governing the usage of and interaction with the Site and the Tutoring Platform.

2. General Applicability

2.1. Eligibility

2.1.1. Student Eligibility

To access and use the Tutoring Platform, Students must be at least 18 years old. If the Student is under the age of 18, they must have the consent of a parent or legal guardian who agrees to be bound by the terms of this Policy, the Terms of Service, and any other relevant policies of the Site. By using the Platform, Students confirm that they meet these eligibility requirements.

2.1.2. Tutor Eligibility

To become a Tutor on the Platform, individuals must meet the following requirements:

  • Be a resident of Ontario, Canada.
  • Be at least 16 years old.

Tutors must also agree to comply with the terms of this Policy, the Terms of Service, and any other relevant policies of the Site. By using the Platform, Tutors confirm that they meet these eligibility requirements.

2.2. User Responsibilities

2.2.1 Student Responsibilities

Students are responsible for:

  • Providing accurate and truthful information when registering, booking sessions, and managing their accounts.
  • Ensuring that their use of the Platform complies with all applicable laws, regulations, this Policy, and the Terms of Service.
  • Using the Platform solely for its intended purpose of engaging in legitimate tutoring services and refraining from any unauthorized or unlawful activity.
  • Maintaining the confidentiality and security of their account details and promptly notifying the Platform in case of any security breach.
  • Complying with all rules regarding session conduct, cancellations, No-Shows, and appropriate behavior during tutoring sessions.

2.2.2 Tutor Responsibilities

Tutors are responsible for:

  • Providing accurate and honest descriptions of their tutoring services, including subjects offered, qualifications, experience, and availability.
  • Maintaining professionalism, providing high-quality tutoring services, and adhering to the standards set forth in this Policy and the Terms of Service.
  • Responding to Student inquiries, session requests, and feedback promptly and professionally.
  • Ensuring that all interactions and activities align with the Platform’s standards for communication, conduct, and any other behavioral expectations set forth in the Platform’s policies.
  • Complying with all rules regarding session conduct, cancellations, No-Shows, and any other relevant behavioral expectations.

2.4. Platform Access

Access to the Platform is granted only to Users who have successfully registered and agreed to comply with the policies, including this Policy, the Terms of Service, and any other applicable policies or guidelines of SimplifyToday. Users who do not agree to these terms should refrain from using the Platform. The Platform reserves the right to suspend or terminate access for any User who violates these terms or engages in harmful or inappropriate behavior.

3. Cancellation Policy

  • Student Cancellations:
    • Cancellations made 24 hours or more in advance: Students will receive a full refund for the session.
    • Cancellations made within 24 hours of the scheduled session: No refund will be provided. However, if the Student reaches out to the Tutor and the Tutor agrees to reschedule, the session will simply be rescheduled at no additional fee. This rescheduling option is at the Tutor’s discretion.
  • Tutor Cancellations:
    • Cancellations made 24 hours or more in advance: Students will receive a full refund for the session.
    • Cancellations made less than 24 hours in advance: If a Tutor cancels within 24 hours, we will offer the Student the option to find a replacement Tutor at no additional charge, even if the replacement Tutor typically charges a higher fee. We will assist the User in finding a suitable alternative.
  • Extenuating Circumstances:
    • We understand that life can be unpredictable. If a Student or Tutor is unable to attend a session due to Extenuating Circumstances (as per the Cancellation, No-Show, and Refund Policy), we will evaluate the situation on a case-by-case basis to determine the best course of action.

4. No-Show Policy

In conjunction with the terms and definitions specified in the Base Cancellation Policy, No Shows within the Tutoring Platform will be handled accordingly:

  • Student No-Shows:
    • If a Student fails to show up for the session without prior notice, no refund will be issued.
  • Provider No-Shows:
    • If a Tutor fails to show up for the session, the Student will receive a full refund for the session, and the Tutor’s conduct will be documented for performance monitoring purposes.
  • Extenuating Circumstances:
    • We understand that life can be unpredictable. If a Student or Tutor is unable to attend a session due to Extenuating Circumstances (as per the Cancellation, No-Show, and Refund Policy), we will evaluate the situation on a case-by-case basis to determine the best course of action.

5. Service Use and Restrictions

5.1. Prohibited Activities

While using the Platform, Users and Providers must not:

  • Engage in any form of harassment, discrimination, or unlawful activity.
  • Misuse platform tools for purposes other than tutoring services.
  • Attempt to circumvent payment or refund systems established by the Site.

5.2. Termination of Access

The Site reserves the right to suspend or terminate a User’s or Provider’s access to the Platform if they violate any of the provisions outlined in this Policy or the Terms of Service.

Modification of Terms

SimplifyToday (“we,” “our,” or “us”) reserves the right to modify this Policy at any time. If we make material changes to this Policy, we will notify users by posting an updated Policy on the Platform, sending a Platform notification, and/or emailing users at the most recent address on file. The Version and Published Date will also be updated to reflect any changes. Your continued use of the Platform following any modifications constitutes acceptance of the revised terms and conditions. Please review this Policy periodically to remain informed of any updates.
